Caldwell Police confirms to CBS2, they are working on an active battery investigation of a bus driver and student.

Jenna Murphy says her 7-year-old son, a second grader at Central Canyon Elementary, just built up the confidence to ride the bus to school.

She says her son is disabled and is now too scared to ride the bus after what she says happened.

Murphy says she was sitting in her driveway waiting for her son to get off the bus, Monday afternoon.

She says saw her son look back to make sure he didn’t forget anything on the bus. That's when she says the bus driver appeared to trip her son, causing him to fall off the bus and onto the ground.

Murphy says she saw the bus driver shake her head, the two made eye contact, then the bus driver shut the door and drove off before she could confront her.

The mom claims this is not the first time the bus driver and her son have had problems. Murphy says her son rides a disability bus and he is one of only two students on the bus who can verbally speak.

She says she worries if this is happening to her son, it could be happening to others.

“He just could only ask, why? Why did it happen to me? Why not somebody else? He was just so confused and so scared and only being 7-years-old there's nothing really else to expect,” Murphy said.

We reached out to Brown Bus Company and they have confirmed this incident is under internal investigation.

Caldwell Police is also investigating, but tonight the bus driver has not been charged.

“I hear it happening all over the world and to hear it happened to my son it really affected me and I just want everybody to know that it is happening here and you don’t know who your kids are really with to take precaution and double check to make sure you kids are safe,” Murphy said.
