Attorney General Raúl Labrador has announced that his office has moved to dismiss all charges against Sara Brady, according to a recent release from the Office of the Attorney General.

Brady was arrested in 2020 for taking her children to a closed playground and charged with misdemeanor trespassing.

This decision was prompted by a unanimous recommendation from prosecutors assigned to the case. General Labrador’s decision was motivated by several factors:

1. There are no allegations that Ms. Brady injured any person or property, or that she physically resisted officers.

2. The evidence, itself, makes it far from certain that any reasonable jury would convict her.

3. The State has already expended far more resources than is typical of misdemeanor cases.

“We know Idahoans have been dealing with significant government overreach. This case should have never been prosecuted," said Attorney General Labrador. It has been a profound waste of precious taxpayer resources. Going forward, we will focus the people’s resources on prosecuting child exploiters and other serious criminals—not mothers who take their kids to the park.”
