Judge could rule soon in Idaho abortion lawsuit
POCATELLO, Idaho (AP) - A federal judge says he'll try to issue a ruling soon in a lawsuit over Idaho's so-called fetal pain law and other abortion restrictions.
The Idaho State Journal reports U.S. District Judge B. Lynn Winmill heard summary judgment arguments Tuesday at Pocatello's federal courthouse.
The lawsuit was filed in 2011 by Pocatello resident Jennie Linn McCormack against Bannock County Prosecutor Mark Hiedeman after the prosecutor charged her with a felony because police said she had an illegal abortion. McCormack's attorney, Richard Hearn, is also a doctor and he's joined the case as another plaintiff, contending that he wants to provide abortion services in the future and that Idaho's laws bar him from doing so.
