E. Idaho family seeks damages from Idaho Falls

IDAHO FALLS, Idaho (AP) - Two eastern Idaho brothers have filed a tort claim seeking damages from Idaho Falls contending police used stun guns on them because they're black.

The Post Register reports that Victor Delosanto Madrigal and Victor Manuel Madrigal filed the tort claims Feb. 24.

Allissa Madrigal, the wife of Victor Manuel Madrigal, also filed a tort claim, a precursor to a lawsuit against a public entity.

Combined the claims seek about $280,000.

On Aug. 31, police responded to a noise complaint. Manuel Madrigal was arrested for battery on an officer, resisting arrest and disturbing the peace. Delosanto Madrigal was arrested for resisting arrest and disturbing the peace.

In February, a jury acquitted Manuel Madrigal of all charges. The City Attorney's Office later dropped all charges against Delosanto Madrigal.

Idaho Falls Police Chief Mark McBride says the officers' actions in August weren't racially motivated.
